Republican Congressman Darrell Issa of California has introduced a resolution aimed at overturning the two impeachments against Donald Trump in the House of Representatives, a move that, according to him, would remedy a situation in which Democrats used “knowingly false” claims in an attempt to “destroy the president’s reputation.”
Resolution H.Res.1211 argues that both impeachment proceedings, approved by the House in 2019 and 2021, should be formally “expunged.”
“The fact is that the Constitution doesn’t spell out what to do when you’ve wrongfully indicted somebody,” Issa told Fox News Digital. “An impeachment is basically an indictment and it’s an indictment that you can’t really be acquitted from. If you are impeached by the House, famously where do you go to get your reputation back, is the question. And that’s sort of a problem that we’re dealing with, which is that the president was wrongfully accused, the evidence is now out that there was withheld information and false information, but where do we go to unring this bell? And the answer is we go back to Congress and we go to the House floor and we have a vote”.
The Resolution
The measure states that the 2019 impeachment, related to pressure allegedly exerted on the Ukrainian government in an anti-Biden context, was based on unreliable and politically biased information. It refers to recently declassified material that, according to the resolution, undermines the credibility of the anonymous whistleblower whose complaint triggered the investigation.
The resolution argues that the whistleblower had no direct knowledge of the facts, was assisted by other officials with alleged political bias, and that House investigators mishandled or misrepresented evidence while denying Trump the opportunity to confront his accusers.
Issa also claims that the 2021 impeachment, which followed the attack on Capitol Hill, was rushed and tainted by procedural irregularities. He noted that the House moved from introduction to approval in just two days and did not conduct a full evidentiary process. Although lawmakers held a brief committee hearing with constitutional experts, the measure advanced without eyewitness testimony or a thorough investigation, which, according to the resolution, denied Trump due process.
“They impeached him for essentially orchestrating an insurrection — an extremely serious crime — but that is false,” Issa said.
Previous Attempts
There have been previous attempts to overturn the impeachment proceedings, including resolutions introduced in 2022 and 2023, but they were never brought forward for debate, consideration, or a floor vote.
Issa explained that the previous resolutions, unlike his own, did not have what he called “the indisputable evidence” needed to demonstrate that the alleged misconduct underlying the accusations should now itself become the focus of scrutiny. His initiative is also backed by one of the leading Republicans in Congress, Jim Jordan, chairman of the House Judiciary Committee.
At the same time, critics — including some legal scholars — argue that while the House may express disapproval of the two measures against Trump, it cannot erase the historical significance of an impeachment or undo the constitutional process once it has taken place.
